Court orders part-time work for ministry employee after childbirth

Istanbul 9th Administrative Court granted the right to work part-time to a female civil servant working at the Ministry of Family and Social Services.

Female civil servants working at the Ministry of Family and Social Services were granted the right to work part-time.

Sağlık-Sen took the rejection of its member’s request to work part-time after childbirth to court. In the lawsuit filed at Istanbul 9th Administrative Court, Sağlık-Sen demanded the annulment of the decision on the grounds that the decision was “unfair and unlawful, there are precedent judicial decisions and the plaintiff’s child is in need of care”. Referring to the article titled ‘part-time work after childbirth’ in the Civil Servants Law No. 657, the court emphasized that it is clear in the relevant article that ‘the civil servant who gives birth can request part-time work until the beginning of the month following the date when the child starts compulsory primary education’. The court stated that the institution’s decision ‘prevents the exercise of a clearly recognized right’ and further stated that ‘it is obvious that the family order will be adversely affected, material and moral difficulties will be encountered and this situation may cause irreparable or impossible damages’.

In this context, the court unanimously ruled for a stay of execution, finding Sağlık-Sen in the right.
