Kamuran Pınar Acar, who was tried in Bursa for keeping her nephew Cem Muhammet A. locked in an apartment that turned into a garbage house, was sentenced to 8 years in prison. The defendant’s daughter Esra Zeynep A., who was tried as a child dragged into crime, was sentenced to 2 years 2 months and 20 days for ‘deprivation of liberty’.

Aydın S., who rented his apartment in the apartment building in Görükle Sakarya Neighborhood of Nilüfer district of Bursa to Kamuran Pınar Acar on July 1, 2020, applied to the court through his lawyer Batuhan Arısoy after Acar failed to pay the rent. The enforcement office sent a notification to Kamuran Pınar Acar, who did not attend the cases held in Bursa 4th Enforcement Law Court, to pay her debt. When Acar did not pay her debts despite the notification, the court ordered the eviction of the house. After the decision, the enforcement team went to the house and found a garbage house when the locksmith opened the door of the apartment. While the door lock of the apartment was changed, the police detained Kamuran Pınar Acar, who disobeyed the court order and came and went to the house with a locksmith. Acar was released with the instruction of the prosecutor’s office after her statement at the police station.

Municipality teams who came to clean found it

After Nilüfer Municipality teams were notified to clean the garbage house, the teams came to the house and realized that the door of a room was locked when they started cleaning. They broke the door and entered the room and found the child lying unconscious in the room full of garbage. Police and 112 Emergency Health teams were notified after it was seen that the child was locked in the room and had even used the toilet in the room. After the first intervention of the paramedics, the child was taken to Bursa Uludağ University Hospital. It was seen that the child, who was kept in the room for about a year, had grown hair and nails, was very weak and had wounds on his body.

Aunt arrested

After the child was found, police teams started an investigation into the incident. While the teams could not reach Kamuran Pınar Acar, it was determined that Cem Muhammet A. was the son of Acar’s sister Yasemin A. It was determined that Acar had not been in contact with her sister for a long time and kept her nephew in a locked room. Kamuran Pınar Acar, who was detained again with the allegation that she had been keeping her nephew for 1 year, was arrested by the judge on the charge of ‘abduction and detention of a child’ after the procedures at the police station. Cem Muhammet A. was sent to his mother in Antalya after his treatment. Cem Muhammet A., who was taken under protection by the Provincial Directorate of Family and Social Services teams in Antalya and taken to Akdeniz University, was placed in the House of Love after his treatment.

Bursa Chief Public Prosecutor’s Office completed the investigation in 5 months. In the 7-page indictment prepared by 2 prosecutors, a lawsuit was filed against Kamuran Pınar Acar, who denied the accusations, demanding 27 years imprisonment for ‘attempted murder with negligent behavior’, ‘child cruelty’, ‘child abduction’ and ‘deprivation of liberty’. The indictment also included a report on Acar’s mental health. It was stated that Kamuran Pınar Acar was mentally healthy on the date of the crime and no weakness was detected.

Acar was released at the 6th hearing of her trial at Bursa 10th High Criminal Court, which had a confidentiality order. The court panel ruled for the release of Kamuran Pınar Acar, who was charged with ‘attempted intentional homicide with negligent behavior’, on the condition of judicial control, taking into account the possibility of changing the nature of the crime attributed to her. After the release decision, Cem Muhammet A., who lives with his mother Yasemin A. in Antalya, was taken under state protection again as a precautionary measure. The Ministry of Family and Social Services was also a party to the case. The Ministry’s lawyers objected to the prosecutor’s office on the grounds that Kamuran Pınar A., who was charged with ‘attempted intentional homicide with negligent behavior’, had the possibility of fleeing abroad despite the judicial control condition, Cem Muhammet had no life safety and there was a risk of abduction, and asked for Kamuran Pınar Acar’s re-arrest. The court ruled that the release decision was appropriate and rejected the objection, and ruled that Kamuran Pınar Acar be tried without arrest on judicial control conditions.

Announcing the verdict at the hearing, the court acquitted Kamuran Pınar Acar on the charge of ‘attempted intentional killing with negligent behavior’, sentenced her to 7 years in prison for ‘torture’ and 8 years in prison for ‘deprivation of personal liberty by using force, threat and fraud’.
