Details emerged regarding the death of 29 people as a result of the fire that broke out in a nightclub under renovation in Beşiktaş and the demand for 9 suspects to be sentenced to imprisonment up to 22.5 years each. On April 2, 29 people, including 2 foreign nationals, lost their lives in a fire that broke out during the renovation of a night club operating on the minus 1 and minus 2 floors of a 16-storey building in Beşiktaş Gayrettepe. The details of the indictment prepared regarding the fire and demanding 9 suspects to be sentenced to imprisonment from 2 years and 8 months to 22.5 years each for ‘causing the death of more than one person with conscious negligence’ have emerged. In the indictment prepared by Istanbul Chief Public Prosecutor’s Office, 29 people were named as ‘deceased’, 27 people as ‘complainants’ and 9 people as ‘suspects’.

Owners of the business identified

In the indictment stating that the complainant suspect Ercan Erkan and the complainant Usamettin Yıldırım, who were affected by the smoke, and Gülden Taşpınar were injured, it was noted that as a result of the work carried out by the Prosecutor’s Office and the expert committee at the scene of the incident, the owners of the business where the incident took place were the suspects Şahzade Şekergümüş, Fatma Dörtgül and Mehmet Memduh Ceylan, the responsible manager was the suspect İsmet Şen, and the people who did the metal works of the business due to the renovation were the suspects Çağatay Altunel and Kahraman Erdem. It was stated in the indictment that suspects Dursun Çelik and Sibel Çelik were the owners of the company that installed the elevator and hydraulically supported stage in the business, and that suspect İbrahim Bildirici was responsible for the renovation and repair works of the business.

It was stated that an electric welding machine plugged into the socket was found after the fire

In the indictment, which also includes the fire report on the incident, it was noted that in the examination made after the fire was extinguished, heavy destruction and deformation based on burning occurred approximately 15 meters from the entrance of the goods acceptance section of the enterprise, and in the detailed examination made in this area, it was observed that there were electric hand tools such as electric welding machine, electric metal cutting motor and various industrial type oxygen cylinders used for renovation purposes and plugged into the socket.

Fire started when sparks ignited flammable materials during welding work

In the indictment, it was stated that the fire started when sparks from the electric welding machine ignited easily flammable materials such as sound insulation, insulation and flooring during welding work, the fire started, developed rapidly and spread around, the employees tried to extinguish the fire with portable fire extinguishers (dry chemical powder), dense smoke was formed in the enterprise during the rapid growth and spread of the fire and the electricity was cut off.

It was noted that the fire cabinets were not working

In the indictment, it was stated that there were no emergency lighting and direction signs in the workplace, the existing sprinkler extinguishing system and fire cabinets did not work, and after the fire was extinguished, people lying motionless at different points in the enterprise were removed from their places and delivered to the health teams within the framework of rescue activities. In the indictment, which also includes the report of the expert committee, the ‘health surveillance’ article in the Occupational Health and Safety Law and the ‘Occupational Health and Safety Training’ article in the Regulation on the Procedures and Principles of Occupational Health and Safety Training of Employees and the ‘Training periods’, ‘Emergency plans, It was also noted that the provisions of the ‘Rules on work equipment’ article of the Regulation on Health and Safety Conditions in the Use of Work Equipment and the ‘Employer’s obligation’ article of the Occupational Health and Safety Risk Assessment Regulation were not complied with.
